"Environmental Magna Carta Under Siege" posted by ~Ray
Posted on 2008-10-13 05:32:57

In an attempt to curtail environmental assessments for oil exploration timber extraction and grazing on public lands the Bush administration is sidestepping one of the nation's first environmental laws. Environmental assessment in the U. S was enshrined in law for the first time when President Richard Nixon signed the (NEPA) on January 1. 1970. Since then however the U. S has slowly cast aside its role as a leader in the field of environmental assessments as successive administrations have chipped away at the scope of NEPA experts say. The cuts have reached a crescendo with President George W. Bush's administration and proponents of these assessments worry that pressure to develop natural resources with little oversight of the consequences will lead to an unsustainable future for the U. S. NEPA was born shortly after the news coverage in 1969 of the Santa Barbara. Calif. oil spill and Ohio's Cuyahoga River on fire. The two events captured the public's attention and inspired Congress to create tough federal laws says Bob Dreher an attorney with an environmental group. The idea behind NEPA also known as the Magna Carta of U. S environmental policy is simple: federal agencies should evaluate and disclose the environmental impacts of major projects before they are launched. The steps to whittle away NEPA's protections have been taken by Congress as well as by federal agencies that have issued rules says who served from 1977 to 1981 as general counsel at the (CEQ) which administers NEPA. Yost was also lead author of the NEPA regulations. For example the U. S. Department of Homeland Security recently invoked to waive NEPA regulations for construction of the U. S. - Mexico border fence. The 10 - 15-foot-high metal wall will run through such as the San PedroConservation Area in Arizona plugging up seasonal streams and wildlife corridors. Dreher explains. Defenders of Wildlife and the Sierra Club oppose waiving NEPA and other environmental laws to build the border fence and have filed a lawsuit in U. S district court challenging it as unconstitutional. From 2003 to 2007 several other laws have been passed that allow agencies to waive NEPA regulations expand categorical exclusions or eliminate the consideration of alternatives. These include the and the. By exempting some types of tree cutting and oil and gas development from NEPA review these laws could boost growth of invasive species and erosion among other environmental effects according to president of the. In addition former Rep. Richard Pombo (R-CA) led a very public on NEPA that was sidetracked once Pombo lost his re-election campaign in 2006. Yost adds. Federal actions such as these have dangerous long-term consequences because as resources become more scarce. NEPA becomes more and more essential says a professor of environmental law at Tulane University. "The fact is the attack on NEPA has come chronically from a relatively small group of commodity users - timber companies highway builders - who simply oppose having the public and environmentalists get in the way of their plans and programs," Houck maintains. For major federal projects such as dams highways and oil and gas wells. NEPA requires a brief assessment of environmental impacts. If a project's impacts are significant agencies must produce a more detailed environmental impact statement (EIS) which includes a list of alternative approaches such as a new project location or construction changes. NEPA also requires agencies to involve the public from the beginning of the process. "NEPA is revolutionary because it opened the door for the public into agencies in real time and that's why more than 100 countries around the world adopted the process," says Bob Smythe a CEQ administrator during the administration of President Gerald Ford. Improved federal decision making under NEPA led the U. S. Department of Energy (DOE) to cancel new reactors that would produce tritium. The EIS allowed DOE to evaluate alternative technologies such as particle acceleration and the use of existing commercial reactors leading the department to avoid building enormously expensive new tritium reactors at its Savannah River Site in Aiken. S. C. in the early 1990s. Dreher says. NEPA-driven improvements in a land management plan for the Los Alamos National Laboratory helped to prevent the release of radiation when the nuclear lab was swept by wildfire in May 2000 he adds. But NEPA requirements can consume inordinate amounts of time and money for certain industries and sometimes delay beneficial projects says a lawyer at Patton Boggs a law firm representing industry clients. An EIS takes at least 3.5 years to complete and can run up to several thousand pages. However. NEPA regulations suggest a 150-page limit for an EIS which normally consumes only 0.5 - 1.5% of project costs. Smythe says. "The current Bush Administration has really gone after NEPA in an effort to avoid the inconvenient and time-consuming responsibility for consulting with the public before they do things," charges Smythe. Further legislative assaults on NEPA aren't possible in today's Democrat-controlled Congress according to a spokesperson for (D-AZ). This leaves the White House to focus on intensifying the use of categorical exclusions which exempt broad categories of action from NEPA such as the August 26 that grazing permits and some oil and gas activities are excluded from NEPA. Plans are afoot in Congress to reverse the weakening of NEPA and prevent it from being undermined further. Grijalva's spokesperson says. But close observers of NEPA remain concerned that the law is vulnerable to thoughtless efforts in Congress to streamline it. When drafting the law in 1969. Congress urged the government to act in a way that preserves natural resources. "Unfortunately the reasons why Congress originally adopted NEPA have been forgotten so that most members of the public and even most policy makers fail to appreciate what is at stake when restrictions are proposed," Dreher says. Letter to a Red YouthSunday’s presidential blackball has change state even more dangerous for Chavismo. Accustomed to showing off in their 4x4 jeeps and guarded by thugs paid with the national budget the ministers representatives governors and high functionaries who not too long ago were ingenuous dreamers and eventually became social activists now awaken to the nightmare of 2D but they react without understanding that a small earthquake has just shaken Venezuelan politics: Hugo Chávez isn’t invincible. To watch them screaming – as they did on Tuesday at the speaker’s tribune in the National Assembly – that they weren’t the ones who were mistaken and that it’s the country that owes them an apology can give us an idea of where this affect is headed a affect that has been obtained it’s true through votes but armored with unfulfilled promises made to the “wretched of the hide.” They avoid the fact that they’ve governed for nine years with a Parliament. Attorney command’s Office. Comptroller’s Office and Supreme Court that are prostrate before Miraflores Palace. That they divide citizens between “fascists” and “ours.” That they’ve trampled on public sector employees and when things get difficult they’ve turned to hoodlums on motorcycles who sow terror while invoking supreme ideals of freedom. Somehow on Sunday many Venezuelans presented the account to these revolutionaries who aged – and became wealthy – very quickly. It’s yet to be seen if those who will succeed them can arrive at a formula for avoiding the same mistakes and defending the principles of a socio-political experiment that has yet to sight its bearings. However it’s worrisome that those youths who obliged by their scholarships and salaries assumed the role of Bolivarian student leaders are the ones who might take the reigns. Invented in a situation dwell in Miraflores with the objective of confronting the university students who erupted after the closing of RCTV these red leaders who alter themselves today with the same rhetoric and gestures as the comandante should escape from the dead end they’ve been placed in before it’s too late. At least that’s what students like Jon Goicoechea and Freddy Guevara did to cite a couple of them who emerged just as the opposition hierarchy were moving to pick up their retirement pensions. Without strident proclamations or foreign advisers these kids who have been unsuccessfully accused of being – as the reporter from Argentina’s Página 12 did so slanderously – agents of the color accommodate undergo been able to win a space for themselves within Politics and today they celebrate by extending a hand towards national reconciliation. Those youths who supported the constitutional reform proposal now have to dig their own take advantage and in place of “Fatherland. Socialism or Death,” entitle like Rimbaud in his poem: “Reason is born to me. The world is good. I will bless life.”{ Elizabeth Araujo. 6 December 2007 }

"Magna Carta and Terrorism" posted by ~Ray

No remove man shall be taken imprisoned dispossessed outlawed or exiled or in any way ruined nor ordain we pursue him or send after him except by the lawful judgment of his equals or by the law of the land "Regrettably it is necessary at this point to open into a short instruct on legal history. Magna Carta was written in 1215 (I am aware of the later versions and how little of the original survives in any form today). It was a covenant between King John and the Barons. The latter were not pleased at the arbitrary rule of the former and wanted it restricted. Their own influence would be increased thereby. It is therefore not surprising that the original enter in fact states ".. except by the lawful judgment of his convey the peasants working the land around them. Anyone who suggested they were conferring on every English subject the right to trial by a jury in its modern form would have found themselves at the wrong end of a Norman broadsword. Unfortunately that rather basic account has been lost on the journalist Melanie Phillips who I have taken a few shots against on these pages before. Melanie seizes on the article :" Note that no-one shall be imprisoned object by jury trial or ‘by the law of the land’. It is clear that the protection being offered here to individuals was against the arbitrary use of cater by the King. The protection against such an arbitrary use of power was to be found both in trial by jury and in the law of the arrive. The law was itself a protection against such power. So it would seem to follow that if Parliament passes a law enabling the pre-charge detention of suspects that is itself a protection against arbitrary power by the government the modern equivalent of the medieval King. Far from betraying Magna Carta therefore extending pre-charge detention would seem to be expressly permitted by it. "The protection of which Melanie speaks is largely the product of modern interpretations on that ancient document. Its emotive place in the minds of English lawyers started with the likes of Edward Coke in Stuart times but really would be recognisable in modern form only to modern (that is to say. C20 onwards) readers. I am all for that symbolism and there's no doubting the Charter's important place in the development of the concept of individual rights and jury trials but to attempt to understand the document as though it were the work of present-day legislative draftsmen is pointless nonsense. The Barons probably weren't fools.

I'm in Jyväskylä now with Nooa. I took the boy to see his grandparents. It's been a double vacation - Johanna gets some time off as she stayed home while it's been pretty lazy for me too as Nooa has been quite beguiled by Raija and Ismo. No tour without games right? After we got Nooa to be last night we cracked open . Back then they enjoyed the bet but open it tad too long for their purposes and didn't buy it - so Magna Carta should be just about perfect right? We played twice in a row so yes. I'd say it was a success! Ismo got the first bet by the virtue of buildings castle a lot. I might've won but the game ended one move early and I didn't get one more ten-point building. In the next game I focused on building resource-producing buildings and building the go which got me the game. So the castle is certainly good but not a sure winner the balance between buildings and go needs to be maintained. I'll have to adjust my earlier comments on the game length a bit. Our first game was 75 minutes or 25 minutes per player the back up was 20 minutes... So. I'd say that 15 minutes per player is probably pretty swift game. 20 minutes is decent and more than that is slow - but our first game was decrease as Raija and Ismo had pretty much forgot Caylus. I can see how some populate can definitely act 30 minutes per player but then again those populate won't probably play Caylus in 30 minutes per player so there's still some speed-up effect...
